Liberal Democrats senator David Leyonhjelm is in the process of drafting amendments to the Smith, many of which align with provisions in the Paterson bill.

Although the result of the poll will not be binding on the government, Prime Minister Malcolm Turnbull has promised that a bill to change marriage laws will be forthcoming.

This legislation echoes fears voiced by the "no" campaign in Australia, which promoted myths that same-sex marriage would lead to "compulsory" gay sex education courses as well as cross-dressing kids.

"The Dean Smith Bill covers who could marry, and could refuse to marry".

Under Senator Paterson's plan, it would also allow any person or business to refuse to co-operate with the staging of same-sex weddings, protecting them from civil litigation under discrimination laws.

It's been two months since the first same-sex marriage ballot papers were sent out, and at 10 a.m. Wednesday November 15, the long-waited plebiscite result will be announced.

The bill would also have a no-detriment clause that would forbid the government and its agencies from withdrawing funding from an organisation that was opposed to marriage equality, professional organisations would not be able to refuse to register a practitioner who opposed same-sex marriage and public servants would not be allowed to be fired for sticking to their beliefs.

On Monday, Liberal MP James Paterson released an alternative bill which seeks to overturn a number of anti-discrimination laws, should same-sex marriage get the go-ahead.

Senator Paterson believes state and federal anti-discrimination laws aren't strong enough.

Cabinet minister Mathias Cormann said his personal instinct was the Smith bill was "probably a good starting position" because it had been subject to a cross-party Senate committee process.

"Australians are voting to make our country a fairer and more equal place, not to take us back to a time where people can be denied service at a shop", said Anna Brown, cochair of the Equality Campaign.
