  • High Court Hears Closing Arguments In Challenge to Kenyan President's Re-Election

In 2000, the US Supreme Court declared former President Goerge Bush the victor, even when it was clear that there were election irregularities.

Judge David Maranga, announcing the verdict, said: "The declaration [of Kenyatta's win] is invalid, null and void".

Kenya's Supreme Court is hearing veteran opposition leader Raila Odinga's challenge to President Uhuru Kenyatta's re-election earlier this month.

A lawyer for President Kenyatta said the decision had been "very political" but had to be respected. "And again, I say peace ... peace, peace, peace", he said in a televised address.

"They can not. Kenyans will decide, and that is the nature of democracy".

Global observers had said they saw no sign of manipulation of voting and tallying at polling stations.

He said it was the first time a presidential result had been overturned in Africa.

IEBC Chairman Wafula Chebukati has vowed not to resign because he was not "personally touched by the Supreme Court ruling".

Commenting on this on Joy FM's Midday News, Mr Lardy Anyenini said Kenya's constitution has progressive provisions which formed the basis for the decision. His 2013 petition was dismissed by the Supreme Court.

For his part, the anonymous African diplomat said Kenya could see a rush of other dissatisfied candidates who lost out in governor, senator or MP races turn to the court with election grievances following the ruling.

Kenya has a long history of disputed votes, election violence and a lack of faith in the judiciary's independence.

He said this had compromised the "integrity of the entire presidential election".

Odinga said: "It's a very historic day for the people of Kenya and by extension the people of Africa. Clear evidence shows that the commission was taken over by criminals. they must face criminal prosecution", he said, naming particular officials.

Paul Muite, representing the electoral commission, said there is no law that specifies the forms for tallying presidential ballots must have security features.

Kenyatta and Odinga will face off in a runoff election within 60 days according to the constitution.

Joyous celebrations erupted outside the court and in Nairobi slums after the second term victory of President Uhuru Kenyatta was declared "invalid, null and void".
