Under the Trump administration, immigration enforcement has changed how they take into account levels of criminality, Homeland Security Secretary John Kelly said on Sunday's "Meet The Press".

As ThinkProgress previously reported, the government's disproportionate response has resulted in immigrants being permanently barred from legalizing their status - or even worse consequences like deportation - regardless of the crime's severity and how many years ago the offense occurred.

"Even a single DUI, depending on other aspects, would get you into the system", he added.

"Yeah, marijuana is not a factor in the drug war", Kelly responded. And we're operating more or less at the other end of the spectrum, and that is criminals, multiple convictions.

The comments stand in stark contrast to those from Attorney General Jeff Sessions, who is critical of legalization efforts in the U.S. Sessions told Fox News again Saturday that the border is closed to illegal immigrants. "This is the Trump era".

"Whether it's veterans or anyone else, if it helps those people, then fine", Kelly said.

Unlike Sessions, Kelly doesn't have much say in how the United States prosecutes drug offenders.

In the interview, Kelly also said that a military strike from North Korea is unlikely amid growing tensions, but noted that the country is a digital danger. "And that is execute and uphold the nation's laws", Kelly said.

'You gotta remember that there's a system, a legal justice system, in place, and the law that deports people, ' he said. "The law deports people". Secretary Kelly doesn't. ICE doesn't. In the first three months of the Trump administration, 54,741 immigrants have been deported, a 1.2 percent drop compared to the same period past year.

Kelly said that has now shifted under President Donald Trump. Anyone can be ticketed or arrested for smoking marijuana in federal parks, after which they would be transferred over to U.S. Immigration and Customs Enforcement (ICE) custody.

Those changes came on the heels of Trump's executive order calling for the deportation of illegal immigrants who "have been convicted of any criminal offense", "have been charged with any criminal offense", "have committed acts that constitute a chargeable criminal offense", or "are subject to a final order of removal".
